Am 23. Februar 1945 wurde eines der berühmtesten Fotos der amerikanischen Geschichte auf dem Mount Suribachi aufgenommen, als fünf amerikanische Soldaten begannen, eine amerikanische Flagge zu hissen. Das Bild, mit dem die meisten Amerikaner sofort vertraut sind, ist zu einem Symbol für die Stärke und Aufopferung der US-Streitkräfte geworden. Obwohl viele wissen, dass es während der Schlacht von Iwo Jima aufgenommen wurde, sind die eigentliche Schlacht und der Kontext des Bildes selbst weitgehend in den Hintergrund getreten.
Die Schlacht um Iwo Jima, die unter dem Codenamen "Operation Detachment" geführt wurde, ist eher eine Fehlbezeichnung als etwas anderes. Sie wurde im Rahmen einer größeren US-Invasion auf dem japanischen Festland ausgetragen und war eher eine Belagerung, die zwischen Februar und März 1945 36 Tage dauerte, wobei jede Minute ununterbrochene Kämpfe stattfanden. Das ikonische Foto der Flaggenhissung wurde vier Tage nach Beginn der Schlacht aufgenommen, und wie dieses Bild zeigt, war die Schlacht kein tadelloses taktisches Ereignis, sondern ein unerbittliches Grauen ohne jegliche Deckung. Wie der erfahrene Schriftsteller James F. Christ im Vorwort zu seiner umfassenden Studie über die Aktion sagte: "Es ist ein Gemetzel ... das ist es, was Iwo Jima war ... das Gettysburg des Pazifiks". Iwo Jima definierte den klassischen amphibischen Angriff der Ära des Zweiten Weltkriegs ebenso wie die Invasion in der Normandie, aber sie fand später im Krieg statt. In Europa war die Ardennenoffensive bereits gewonnen, und die deutschen Streitkräfte würden Anfang Mai kapitulieren. Das japanische Imperium war jedoch immer noch sehr stark und entschlossen, und eine grundlegende Offensive, die sich von Insel zu Insel, von Marineeinheit zu Marineeinheit und von Luftwaffe zu Luftwaffe erstreckte, stieß auf den erbitterten Widerstand des Feindes.
Ende 1944, als die alliierten Streitkräfte über den Pazifik vorrückten und immer näher an Japan heranrückten, wurden Pläne für die Invasion der Ryuku-Inseln ausgearbeitet, von denen Okinawa die wichtigste war. Die militärischen Planer gingen davon aus, dass der amphibische Feldzug eine Woche dauern würde, aber statt der geschätzten 60.000 japanischen Verteidiger befanden sich zu Beginn des Feldzugs im April 1945 etwa 120.000 auf der Insel. Die Schlacht um Okinawa war die größte amphibische Operation im pazifischen Raum. Sie dauerte fast drei Monate und sollte sich als die heftigste im pazifischen Raum während des Krieges erweisen, mit fast 60.000 amerikanischen Opfern und mehr als 100.000 gefallenen japanischen Soldaten. Darüber hinaus forderte die Schlacht zwischen 40.000 und 150.000 Opfer unter der japanischen Zivilbevölkerung.
Okinawa war Zeuge aller nur denkbaren Schrecken des Krieges, sowohl an Land als auch auf See. Die US-Bodentruppen auf Okinawa hatten mit schlechtem Wetter (einschließlich eines Taifuns), Panzerabwehrgräben, Stacheldraht, Minen, Höhlen, unterirdischen Tunnelnetzen und fanatischen japanischen Soldaten zu kämpfen, die bereit waren, im Kampf auf Leben und Tod menschliche Schutzschilde einzusetzen. Many foreign policy analysts assume that elite policymakers in liberal democracies consistently ignore humanitarian norms when these norms interfere with commercial and strategic interests. Today's endorsement by Western governments of repressive regimes in countries from Kazakhstan to Pakistan and Saudi Arabia in the name of fighting terror only reinforces this opinion. In Just Politics, C. William Walldorf Jr. challenges this conventional wisdom, arguing that human rights concerns have often led democratic great powers to sever vital strategic partnerships even when it has not been in their interest to do so.Walldorf sets out his case in detailed studies of British alliance relationships with the Ottoman Empire and Portugal in the nineteenth century and of U.S. partnerships with numerous countries-ranging from South Africa, Turkey, Greece and El Salvador to Nicaragua, Chile, and Argentina-during the Cold War. He finds that illiberal behavior by partner states, varying degrees of pressure by nonstate actors, and legislative activism account for the decisions by democracies to terminate strategic partnerships for human rights reasons.To demonstrate the central influence of humanitarian considerations and domestic politics in the most vital of strategic moments of great-power foreign policy, Walldorf argues that Western governments can and must integrate human rights into their foreign policies. Failure to take humanitarian concerns into account, he contends, will only damage their long-term strategic objectives.

She shows how what she calls "sociolegal positivism" is more important than the natural law/positive law distinction for understanding modern law. Modern law is a social and sociological phenomenon, whose instrumental, power-oriented, sometimes violent nature raises serious doubts about the continued possibility of justice. She shows how particular views of language and speech are implicated in such law. But law--like language--has not always been positivist, empirical, or sociological, nor need it be. Constable examines possibilities of silence and proposes an alternative understanding of law--one that emerges in the calling, however silently, of words to justice. Profoundly insightful and fluently written, Just Silences suggests that justice today lies precariously in the silences of modern positive law.
