Dieser Ansatz folgt Hegel, der in seiner Logik eine positiv-vernünftige Methode entwirft, den Zusammenhang der Wirklichkeit zu denken. An ein Verständnis der Dialektik als Kritik und Methode knüpft der vorliegende Versuch an, den Problembestand einer ‚Dialektik der Gegenwart' systematisch darzustellen.

Hierzu lenkt der Autor den Blick unter anderem auf den in der Rechtslehre bislang wenig behandelten Fall des Inhaltsirrtums nach § 2078 Abs. 1 Alt. 1 BGB, in dem sich der Erblasser über die Bedeutung eines Wortes irrt. Perkams zeigt auf, dass das Gesetz auch im Testamentsrecht von einer objektiven Auslegung ausgeht. Er plädiert dafür, von vornherein auf einen rein subjektiven Standpunkt zu verzichten mit der Folge, dass das Auslegungsmaterial nicht unbegrenzt zur Verfügung steht.Im zweiten Teil wendet sich der Autor dem spanischen Recht zu. Hierbei analysiert er die maßgebliche Vorschrift im spanischen Zivilgesetzbuch (Art. 675 CC), die die methodischen Vorgaben für die Testamentsauslegung bereithält. Es wird deutlich, dass die Andeutungstheorie auch in Spanien Fuß gefasst hat und es, anders als in Deutschland, praktisch keine Verfechter einer Gegenansicht gibt, die den Ansatz einer vollkommen freien Auslegung vertreten. Dies erscheint bemerkenswert, da das spanische Testamentsrecht keine dem § 2078 Abs. 1 BGB vergleichbare Vorschrift kennt, zugleich aber die Regel von der falsa demonstratio ausdrücklich normiert.

In der Arbeit werden zunächst die Bedeutung des Wettbewerbs im Vergaberecht und dessen Verhältnis zum Wettbewerbsrecht untersucht. Anschließend werden allgemeine vergaberechtliche Grundsätze dargestellt. Dabei werden ihre wettbewerbspolitische Funktion und die darüber hinausgehende Bedeutung beleuchtet. Weiterhin wird untersucht, wie wettbewerbswidrige Verhaltensweisen auf Bieter- oder Auftraggeberseite unter vergaberechtlichen Gesichtspunkten systematisiert werden können. Auch wird thematisiert, inwieweit wettbewerbsrechtliche Ansprüche vor den Vergabenachprüfungsinstanzen geltend gemacht werden können. Aus der Untersuchung resultiert, dass die praktische Bedeutung des Wettbewerbsrechts im Vergaberecht gering ist, denn das Vergaberecht verfügt bereits über eigene Instrumente, mit denen verschiedene Wettbewerbsprobleme ohne den Umweg über das Wettbewerbsrecht unterbunden werden können.The Significance of Competition Law in Public Procurement Law: The study deals with the significance of competition law in public procurement law. Arnd Weißgerber untersucht die Beendigung des Schuldnerverzugs durch nachträgliche Leistung unter dem Aspekt des Auseinanderfallens von Leistungshandlung und Leistungserfolg. Nimmt der Schuldner die geschuldete Handlung rechtzeitig vor, gerät er mangels Verschuldens von vornherein nicht in Verzug. Hieraus folgert die herrschende Meinung, dass der Verzug bereits durch die Vornahme der Leistungshandlung beendet wird. Demgegenüber vertritt der Autor ein funktionales, erfolgsbezogenes Modell. Maßstab für die Verzugsbeendigung ist danach, bis zu welchem Zeitpunkt der Gläubiger Nachteile aus der schuldhaften Leistungsverzögerung des Schuldners erleiden kann. Dies führt zu dem Ergebnis, dass der Verzug regelmäßig erst mit dem Eintritt des Leistungserfolgs endet.In einem ersten Schritt wird untersucht, welche Vorstellungen dem handlungsbezogenen Konzept der herrschenden Meinung zugrunde liegen und welche Erwägungen im Rahmen der Gesetzesberatungen zum BGB angestellt wurden. Anhand konkreter Einzelfälle weist der Autor nach, dass der handlungsbezogene Ansatz der herrschenden Meinung unstimmig ist und zu unangemessenen Ergebnissen führt. Auf Grundlage des hier vertretenen, erfolgsbezogenen Ansatzes werden schließlich wichtige praktische Anwendungsfälle erörtert. Es handelt sich dabei um Fälle, in denen dritte Personen in den Leistungsvorgang eingeschaltet werden oder in denen der Leistungsgegenstand ohne Erfüllungseintritt verschafft wird.

Die Anforderungen der Rechtsprechung an die Begründung von Verfahrensrügen sind rigide. § 344 Abs. 2 S. 2 StPO wird als Schlüssigkeitsgebot ausgelegt und vom Revisionsführer verlangt, Verfahrenstatsachen so vollständig und aus sich heraus verständlich anzugeben, dass das Gericht allein anhand der Revisionsbegründung - Erweisbarkeit vorausgesetzt - endgültig entscheiden kann, ob ein Verfahrensfehler vorliegt. Ralf Ritter zeigt, dass diese Auslegung sich strukturell obrigkeitsstaatlichen Begründungsanforderungen annähert, die der historische Gesetzgeber überwinden wollte. Dargelegt wird, dass das Schlüssigkeitsgebot zwangsläufig uferlos ist und die für seine Geltung angeführten teleologischen Gründe einer Überprüfung nicht standhalten. Der Autor schlägt stattdessen eine systematische Ableitung der Begründungsanforderungen aus der auf eine Entscheidungskontrolle gerichteten Struktur der Revision vor. Die Begründung der Verfahrensrüge muss dem Gericht die zielgerichtete, selektive Kontrolle einer bestimmten prozessualen Stelle ermöglichen.

Fatoş Özdemir widmet sich der Frage, ob die durch das BVerwG geprägte Abwägungsdogmatik durch das Europarechtsanpassungsgesetz Bau (EAG Bau 2004) einen Paradigmenwechsel erfahren hat. Die Arbeit beginnt nach einer prägnanten Einführung in die Fragestellung zunächst mit den Grundlagen des bauplanerischen Abwägungsgebots. Im Vordergrund steht hierbei die vom BVerwG entwickelte Abwägungsfehlerlehre. Im Ergebnis plädiert die Autorin für den Verzicht auf die Unterscheidung zwischen Abwägungsvorgang und Abwägungsergebnis. Anschließend widmet sie sich den Planerhaltungsvorschriften des EAG Bau. Untersucht wird das Verhältnis der §§ 1 Abs. 7 und 2 Abs. 3 untereinander sowie das Verhältnis beider Regelungen zu § 214. Unter kritischer Berücksichtigung der in der Literatur vorgeschlagenen Ansätze entwickelt die Autorin hierbei eine eigene Konzeption im Umgang mit den neuen Regelungen des EAG Bau. Die Arbeit schließt mit Vorschlägen zur Modifikation der Terminologie.
