Bei der traditionellen Sozialauswahl geht es um die Verteilung der Arbeitsplätze innerhalb der Gemeinschaft des Betriebes. Problematisch wird es jedoch, wenn dem Arbeitgeber aufgegeben wird, Arbeitsplätze über den Betrieb hinaus zu berücksichtigen. Mit diesem Problem sowie dem "Freikündigungsanspruch" sondergeschützter Arbeitnehmer befasst sich die Autorin. Nach einer allgemeinen Systembetrachtung des KSchG wird zunächst der Frage der Funktionalität der Arbeitsplatzverschaffung im Gemeinschaftsbetrieb nachgegangen. Entscheidendes Kriterium für einen arbeitgeberübergreifenden Kündigungsschutz im Gemeinschaftsbetrieb ist dessen Vollziehbarkeit, welche jedoch nur dann gewährleistet ist, wenn die Arbeitgeber sich auch hinsichtlich der Anwendung des KSchG auf den gesamten Gemeinschaftsbetrieb einer erzwingbaren Verhaltensabstimmung durch eine einheitliche Leitung unterworfen haben. Auch im Konzern gibt es keinen Verschaffungsanspruch - gleich ob auf individual- oder kollektivrechtlicher Grundlage. Ein derartiger Anspruch ließe sich auch nicht durchsetzen, denn der Arbeitnehmer kann von seinem Arbeitgeber nicht verlangen, den Abschluss eines Arbeitsvertrages bei einem Drittunternehmen zu erzwingen. Im letzten Teil der Arbeit wird nachgewiesen, dass auch bei Vorliegen eines Sonderkündigungsschutzes keine Obliegenheit des Arbeitgebers zur Arbeitsplatzverschaffung durch Freikündigung besteht. Die Verdrängung des einen Arbeitnehmers durch einen anderen ist im KSchG ausschließlich durch die Sozialauswahl vorgesehen. Das KSchG hat den Wettbewerb um Beschäftigung abschließend geregelt.
