Jeder Strafrechtsordnung stellt sich beim Auftreten einer Straftatkonkurrenz zum einen die Frage nach der adäquaten Fassung des Schuldspruches, zum anderen die Frage nach dem Umgang mit dem Zusammentreffen mehrerer Strafdrohungen. Ziel der vorliegenden Untersuchung ist die Beantwortung dieser Fragen für das Völkerstrafrecht.Zuerst werden die lückenhaften Regelungen der vorhandenen völkerstrafrechtlichen Satzungen im Wege einer Rechtsvergleichung zwischen dem kontinentaleuropäischen und dem angloamerikanischen Rechtskreis um Orientierungspunkte in Form gemeinsamer Rechtsgrundsätze ergänzt. Sodann wird die praktische Behandlung der Konkurrenzproblematik durch das Jugoslawien- und das Ruanda-Tribunal dargestellt, bevor zum Abschluß einzelne mögliche Konkurrenzkonstellationen behandelt werden.Im Ergebnis werden allein für die Frage nach der adäquaten Fassung des Schuldspruches gemeinsame Rechtsgrundsätze aufgefunden. Diese entsprechen den in Kontinentaleuropa als Spezialität, Konsumtion und Subsidiarität bekannten Fallgruppen. Bei der Behandlung möglicher Konkurrenzkonstellationen ergibt sich daraus unter anderem, daß ein kumulativer Schuldspruch immer zulässig ist, wenn Verbrechen aus den verschiedenen völkerstrafrechtlichen Verbrechensgruppen zusammentreffen, nämlich Kriegsverbrechen, Menschlichkeitsverbrechen und Völkermord.

Dazu gaben insbesondere zwei Urteile Anlass, die in Deutschland für ein außerordentlich starkes Echo gesorgt hatten. In beiden Fällen waren Arbeitsverhältnisse eines kirchlichen Mitarbeiters wegen außerehelicher Beziehungen gekündigt worden und die hiergegen gerichteten Arbeitsgerichtsverfahren erfolglos geblieben. Während der EGMR im sog. Mormonenfall keine Verletzung des Rechts auf Privat- und Familienleben nach Art. 8 EMRK annahm, ging er im Fall eines katholischen Kirchenmusikers von einer solchen Verletzung aus. Für die Praxis stellt sich nicht nur die Frage nach den Gründen für die unterschiedliche Behandlung der beiden Fälle. Die verschiedenen Reaktionen zeigen auch, dass die Konsequenzen einer Entscheidung des EGMR für das nationale Recht der Erläuterung bedürfen. Nicht zuletzt besteht Unsicherheit sowohl für kirchliche Arbeitgeber wie auch für Arbeitsgerichte, wie künftig mit vergleichbaren Fällen umzugehen ist.

Vielmehr betrachtet sie das Streikrecht und das Verweigerungsrecht auch im Rahmen internationaler Rechtsquellen. En las montañas de Lasta, al norte de Etiopía, en lo alto de una árida meseta en las estribaciones, el asentamiento de Lalibela dormitó durante siglos como poco más que un lugar de peregrinación al final de un largo y fatigoso sendero. Las antiguas rutas comerciales entre la costa eritrea y los reductos de las tierras altas centrales que más tarde se convertirían en la capital imperial de Addis Abeba pasaban a ochenta kilómetros al este de Lalibela, y desde principios del siglo XIII, tras el fallecimiento del propio Gebre Mesqel Lalibela, el lugar entró en decadencia. El centro de atención del gobierno imperial se desplazó hacia el sur, bajo la influencia de sucesivos emperadores, a medida que los lugares sagrados de Roha desaparecían de la conciencia popular. Sólo un grupo ocasional de peregrinos atravesaba los escarpados puertos de montaña y los altos valles sin agua para descansar en el mítico lugar, ahora sólo conocido por un puñado de fieles acólitos.
thLa primera vez que Europa se fijó en este lugar fue a principios del siglo XVI, cuando lo visitó el explorador portugués Pêro da Covilhã, que partió de Zeila, en la costa somalí, en busca del legendario reino del Preste Juan. Fue recibido por el emperador Eskender, pero permaneció prisionero en Etiopía durante 30 años. Durante ese tiempo, visitó Lalibela y dejó constancia de sus impresiones.
También fue en busca del reino del Preste Juan el misionero portugués Francisco Álvares, que llegó a Etiopía en 1515 como parte de una misión de embajador autorizada por el rey portugués Manuel I. Allí, en la corte del emperador Dawit II, conoció a numerosos europeos diversos, entre ellos Pêro da Covilhã y Nicolò Brancaleon, pintor veneciano que se estableció en Etiopía en 1480 y cuya influencia artística sigue siendo visible en la imaginería eclesiástica de todo el país.
Fue Álvarez quien describió con detalle los monumentos de Lalibela en su exhaustivo cuaderno de viaje, A True Relation of the Lands of Prester John of the Indies. El explorador escribió: "A un día de camino de esta iglesia de Imbra Christo hay edificios, como los cuales y tantos, no se pueden, según me parece, hallar en el mundo. Son iglesias enteramente excavadas en la roca, muy bien labradas. Los nombres de estas iglesias son estos: Emanuel, San Salvador, Santa María, Santa Cruz, San Jorge, Gólgota, Belén, Marcoreos, los Mártires. La principal es Lalibela. Este Lalibela, dicen, fue Rey en este mismo país durante ochenta años, y fue Rey antes que el antes mencionado que se llamaba Abraham. Este Rey ordenó que se hicieran estos edificios. No yace en la iglesia que lleva su nombre, yace en la iglesia del Gólgota, que es la que menos edificios tiene aquí".
En 1550, Giovanni Battista Ramusio, geógrafo y escritor de viajes italiano, publicó en Venecia una edición del libro de Álvarez. Esta versión incluía numerosos dibujos y planos, pero quién suministró estas ilustraciones sigue siendo un misterio. El siguiente visitante europeo conocido del lugar fue Miguel de Castanhoso, un soldado de bajo rango al servicio de Cristóvão da Gama, diplomático y militar portugués que dirigió una cruzada militar agresiva, pero finalmente infructuosa, a Etiopía entre 1541 y 1543. No se sabe qué llevó a Miguel de Castanhoso a Lalibela, ni tampoco quedaron registradas sus impresiones.
En los albores del siglo XVIIth , la influencia portuguesa en África entró en declive, y las ocasiones de contacto europeo con Etiopía se hicieron muy escasas y distantes entre sí. Pasarían otros tres siglos antes de que otro europeo se aventurara en los recintos sagrados de Lalibela como parte de una expedición militar británica montada en 1867. Así pues, el "redescubrimiento" de las notables iglesias y la historia del cristianismo en Etiopía sólo se escribirían recientemente.
